Planning Appeals, including Appeals for Costs
We understand that the road to Planning Permission does not always run smoothly. If you have previously had planning permission refused, or need professional representation for a forthcoming Planning Appeal, Fytche-Taylor Planning can assess your options.
In all cases, and prior to offering advice on the likelihood of success, we will undertake a detailed analysis of the application, plus the reasons for refusal and relevant case law. The fee for this review will be based on the consultant time required, which will differ according to the complexity of the application/appeal and reasons for refusal.
Our consultant will devise a strategy to identify the options for either preparing and submitting an appeal, or to resubmit a revised planning application if the reasons for refusal can reasonably be overcome without the need for an appeal. We pride ourselves on frank and honest advice, and therefore if the potential success of an appeal is deemed to be limited due to the way the original application was made (for example, if there was key information missing) we will make this clear so that the risks are known and any further work is properly informed.

Case Study - Collingham, Nottinghamshire Appeal Won & FULL COSTS awarded!
Our team secured full planning permission at appeal, together with full award of costs against the LPA (Newark & Sherwood District Council) for our client’s residential site in Collingham’s Conservation Area, in north Nottinghamshire.
Following non-determination after more than 8 weeks and numerous errors made by the case officer, we lodged a detailed appeal. Based on our evidence and the case we prepared, the Planning Inspector concluded that the LPA had acted unreasonably and agreed that our excellent design and the redevelopment of the brownfield site would make a positive contribution to the locality and in particular the conservation area.

Commenting on Planning Applications
Do you need advice or support with a consultation response? When a planning application is submitted near your home or business you may want to make a formal representation to the council. This can include making an objection, providing a general observation, or lending your support to the proposed development.
To ensure that a response carries as much weight as possible it must focus entirely on core planning matters that the planning authority is able to take into account. The gravitas of a response will hold greater impact where the comments relate specifically to local or national planning policies too - and this is where our professional Town Planning Consultant advice is crucial.
Unfortunately, there are also some issues that by law cannot be considered by the local planning authority when making their decisions.
